The information generated by Google Analytics about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information only for the purpose of evaluating your use of the website, compiling anonymised evaluations and charts on website activity like number of visits, number of pages accessed per user etc. We however do not have access to your personal data, and can also not indirectly identify you. We use these exclusively for purposes of internal market research and, above all to optimize and structure our websites as required. Social media cookies are used to enable integration of social media into our websites, so that you can immediately like or share a page or product on your favourite social media service. The social media platforms used are Facebook, Twitter, LinkedIn and Google.

 

Cookies which enable behavioural advertising, to make the advertisements provided to you on our websites more interesting and relevant to you.

ii. On what basis?

Tartex has a legitimate interest in maintaining and improving its websites. For this reason, functional cookies are by default used when you visit us online

2. If you are a consumer

At Tartex we respect your right with regards to data privacy and data protection. As consumer we process different kinds of personal information for different purposes.

a) Marketing (for example, if you signed up for a newsletter, marketing campaign or competition)

i. What information is used and why?

If you signed up for one of our newsletters, marketing campaigns or competitions we will process personal information you provided directly to us in order to execute the services. If you provide your personal details through social media, we will use these as long as it is in line with the terms and conditions of our competition. We do not target children in our marketing initiatives.

ii. On what basis?

We only store personal information from consumers for newsletters and participation in competitions with your consent. You can withdraw your consent at any time by following the instructions in our communications or via a direct email. In case you participate in our surveys, we might use a third party tool to send out the survey and collect the findings. In case we do, it will be stipulated in the survey T&C.

b) Complaints, feedback and questions

i. What information is used and why?

If (you fill in the contact form on our website, or if you) send us an unsolicited e-mail, then we will store your information as long as necessary depending on the nature and the content thereof, to ensure that we can fully answer and process your communication. (Our online contact form will ask you to fill in your contact details and a comment section.) In case you file a complaint we will respond and investigate your case based on legal obligations. In case you give us feedback or pose a question we will respond accordingly to handle your case and maintain customer and consumer relations (which is in our legitimate interest). In case you provide medical data to us in the comment section/e-mail, we will only use this to handle and process your communication and take necessary follow-up actions. This could involve answering your question, responding to your feedback and handling your compliant, or keep it in case of legal actions. In case you approach us on social media with your question, feedback or complaint, we will respond initially, but kindly request you to use the proper channel for communication.

ii. On what basis?

 At  we have a legitimate interest to handle your questions and feedback in order to improve our consumer  and customer relations. Next to that, we also anonymize your data before conducting statistics and management reports, so that we can learn from your input, and improve our products and service accordingly. In the case of handling complaints, we are legally obliged to investigate and handle your complaint and might store them longer in order to defend ourselves in lawsuits.

3. If you are a business customer or supplier

i. What information is used and why?

If you are a business customer or supplier we process personal information which you have provided directly to us. We store your name, email address and phone number in CRM systems for the general administration, management of purchases, deliveries, invoicing as well as handling complaints regarding our products and deliveries. If you visit our premises, you might be subject to our surveillance cameras for security purposes.

ii. On what basis?

At Tartex, we collect and process personal data of customers and suppliers in order to fulfil our mutual contract. Furthermore, we might collect and store this data for legitimate interest in order to communicate with each other and ensure that we can continue doing business. We might send you newsletters and direct marketing regarding similar products to the ones you have purchased already based on legitimate interests.

4. Other Use

This privacy notice is a general notice. We might use your personal information in other situations and for different purposes than described here. If this is the case, we will always do our best to provide you with more specific information than already mentioned in this notice. 5. With whom we share your personal information

i. Within Wessanen

Tartex is a group of organisations. Your personal information may be shared with other legal entities part of Allos Hof-Manufaktur.

ii. Service providers

We use third parties to provide services for some of our activities. Some examples of these third parties are software providers, external call centres, website hosting companies, etc.

Tartex will only disclose your personal information to third parties with whom we have a processing agreement or that have agreed in writing to provide an adequate level of protection.

iii. In case of a legal requirement to disclose your personal data

Finally, we might provide your personal data to third parties (i.e. government organisations), if there is a legal obligation under European law or EU Member state law to do so.

6. How we keep your personal information safe

i. Security measures

At Tartex, we maintain appropriate administrative, technical and organisational measures designed to help safeguard the confidentiality, availability and integrity of your personal information and to protect it against accidental or unlawful destruction, accidental loss, unauthorised alteration, disclosure or access, misuse, and any other unlawful form of processing of the personal information in its possession. In line with data protection laws and internal Tartex policies, Tartex addresses security at all appropriate technology infrastructure points.

Tartex trains employees regarding its data privacy policies and procedures and only permits authorized employees to access your personal information on a need-to-know basis, as required for their function.

ii. International transfers

European data protection law prohibits the transfer of personal information outside the European

Economic Area ("EEA") unless specific requirements are met for the protection of that personal

information. We will only carry out such transfers where we are confident that the level of protection

applied to your information will be similar as if it had remained within the EEA. For transfers outside of

the Tartex network, such as to our service providers, we enter into 'model clause' data transfer agreements or rely on some other approved data transfer method to ensure adequacy.

 

The following are examples of where and how your information may be transferred, but please note this is not an exhaustive list and that due to ongoing changes in our IT and operational infrastructure this may change at any time: Use of Microsoft and Skype Business for communication and use of SaaS solutions which are stored in the cloud (SAP).

7. How long we keep your personal information

Tartex will store your information in line with retention periods as defined by applicable law. We will retain your personal information for only as long as appropriate to fulfil the purposes for which Wessanen collected that personal information or as long as a legal basis exists. General retention periods can be defined as follows:

i. If you have entered into a contract with us

If you have provided us with personal information for the performance of a contract (for instance when buying something in our online shops), we will generally keep this information as long as this is necessary for the performance of this contract, except when we are legally required to retain the information longer or when you have agreed to another use of your information.

ii. If you have provided us with your consent

When you have consented to our use of your personal information, we will only keep the information for as long as the consent is valid. The exact time for which we will keep your personal information will differ in each situation, but we will take your reasonable expectations into account when determining for how long we will use your consent.

iii. If we have collected and/or are using your personal information for a legitimate interest

When we keep your personal information for a legitimate interest, we will only use the information for as long as we have a legitimate interests. The exact time for which we will keep your personal information will differ in each situation, but we will take your rights and freedoms into account when determining for how long we keep your information.

iv. If we have collected your personal information because of a legal requirement

When we have collected your personal information for a legal requirement we will keep your personal information for as long as we are legally required to keep it, and erase it if we no longer have another purpose for which we are allowed to use the information after the legal retention period expires.

8. Social Media

6.1 Facebook Page

6.1.1 Shared Responsibility

Regarding our data processing via our Facebook Page (page insights) there is a contract with Facebook governing the shared responsibility according to Art. 26 DSGVO (Page Controller Addendum“, https://www.facebook.com/legal/terms/page_controller_addendum).

6.1.2 Description, purpose and legal basis of data processing

In addition to this website, we also operate social media channels on Facebook, such as https://www.facebook.com/pg/AllosBioOriginale/, https://www.facebook.com/CupperTeas/ and https://www.facebook.com/TartexOriginal/ (Facebook pages) through which we present our company, publish information about our products and communicate with our customers. 

We only process personal data when you interact with our Facebook pages, e.g. if you leave a comment, click a Like button or send us a message.

The legal basis for data processing in this way is, depending on the nature of your activity, Art. 6 para. 1 lit. b DSGVO (for example, if you send us a contract-relevant request), or your consent under Art. 6 para. 1 lit. a DSGVO (for example, if you "like", comment on or post content on our Facebook page).

6.1.3 Analysis of user behavior

We analyze the views and interactions on our Facebook pages. For this purpose, Facebook uses user profiles, but only provides us with anonymous data in this regard, so-called page insights. This is aggregated data that helps us understand how users interact with our Facebook page. The legal basis for this data processing is Article 6 (1) (f). DSGVO, as we have a legitimate interest in marketing our company through social media and analyzing and evaluating the use of our Facebook page to improve our offerings and services.

6.1.4 Data usage by Facebook

When you use and access our Facebook pages, your personal information will also be collected by the Ireland-based company Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbor, Dublin and the US-based Facebook, Inc., 1601 Willow Road, Menlo Park, California 94025 (hereafter "Facebook"). In addition to the processing described above, Facebook also processes your data for analysis and advertising or personalized advertising. In doing so, - to our knowledge -, Facebook also uses cookies, which store your usage behavior (even across different devices). As a result, Facebook can play targeted advertising within the framework of its own platform as well as third party websites. According to the Facebook privacy policy, user data is also processed in the US or other third countries. Facebook transmits user data only to countries for which a decision on appropriateness of the European Commission pursuant to Art. 45 GDPR exists or on the basis of suitable guarantees pursuant to Art. 46 DSGVO. Facebook Inc. is certified under the EU-US Privacy Shield and thereby offers an appropriate level of data protection according to Art. 45 DSGVO (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

6.1.5 Possibility of Revocation and Objection

You may revoke your consent at any time by deleting the comment or its content. A revocation does not affect the legality of the processing until the revocation on the basis of the consent.

Facebook offers the possibility to dispute certain data processing; Notes and opt-out options can be found at https://www.facebook.com/policies/cookies/ and for logged-in users at https://www.facebook.com/settings?tab=ads.

In addition, data processing via cookies used by Facebook can be prevented by the adjusting your browser settings so that cookies of third-party providers or those of Facebook are not being accepted.

6.2 Social Media Channel on Instagram

6.2.1 Shared Responsibility

As operator of the Instagram channel, together with the operator of the social network Instagram, Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland, we are responsible within the meaning of Art. 4 No. 7 GDPR.

When visiting our Instagram page personal data is processed by Instagram.

As the person in charge of this site, we have made agreements with Facebook which, among other things, regulate the conditions for using Instagram. Relevant are the terms of use of Facebook, which are available at https://www.facebook.com/legal/terms and https://help.instagram.com/581066165581870.

6.2.2 Description, Purpose and Legal Basis for Data Processing

 

In addition to this website, we also run a social media channel on Instagram, https://www.instagram.com/tartex_vegetarianfoodlover/ (Instagram channel), on which we represent our company, inform about our products and communicate with our customers.

We process personal information when you interact with our Instagram channel, e.g. if you leave a comment, click a Like button or send us a message. We do not share the data with third parties.

The legal basis for data processing in this way, depending on the nature of your activity, is your consent under Art. 6 para. 1 lit. a DSGVO (for example, if you "like" a comment from us, comment on it or upload content on our Instagram page) or our legitimate interest under Art. 6 para. 1 lit. f DSGVO, because we legitimate interest in marketing our company through social media.

6.2.3 Data Processing by Facebook

Processing of information and data on Instagram enables Facebook to improve its advertising system that is distributed across its network. For more information about data processing through Facebook, see the Instagram Privacy Policy at https://www.facebook.com/about/privacy/update.

Data processing via cookies used by Facebook can also be prevented by adjusting your browser setting to disallow cookies of third-party providers or those of Facebook.

On our website you will find the following social plug-ins as buttons, through which you can access our channels in the following social networks:

The social plug-ins are only displayed on our site. They are designed as inactive icons. If you click on such a social plug-in on our site, it will be activated with your consent and connected to these third-party providers via your web browser in a separate browser tab. These third party providers can thereby track the visit to our sites. If you are a member of one of the social networks, you can share the content of our site with other members of your social network by activating the corresponding button. We have no influence on the personal data collected and stored by third parties. We also have no influence on the content of third-party sites. In the interest of data protection, we use a solution that transmits to these services only the address of our server and not your IP address, if you have activated a social plug-in by clicking.

6.4 Purpose of Integration of Video/Social-Plug-Ins

 

The integration of social plug-ins exclusively serves the purpose of customer-friendly design of our website. In this way, we are pursuing the legitimate interest in optimizing access to our services, which is permitted under Art. 6 (1) (f) GDPR.

Right of access

You have the right to know what personal information Tartex processes and why. You also have the right to obtain a copy of the personal information we have on you.
